These Terms of Service ("Terms") are a legal agreement between you and Chibi Art and govern your use of the Chibi Art services including our website, mobile apps, and other features or services (collectively, the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
By accessing or using the Service, you confirm your acceptance of these Terms and agree to be bound by them. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms.
Chibi Art reserves the right, at its sole discretion, to modify or replace the Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Updates to our Acceptable Use Policy or content moderation requirements may be implemented with shorter notice periods when required by our payment processors, partners, or applicable law.
Chibi Art operates as an independent AI content generation platform. Our Service provides a custom user interface and additional features built on top of third-party AI models. We are not affiliated with, endorsed by, or sponsored by the underlying AI model providers. All AI-generated content created through our platform is subject to mandatory content filtering and moderation as described in these Terms and our Acceptable Use Policy.
You may be required to register for an account to access certain features of the Service. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for all your activity in connection with the Service. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your right to access or use the Service. Additionally, you are strictly prohibited from using the Service to generate, create, upload, share, or request the generation of any NSFW (Not Safe For Work) content, sexually explicit content, nude or semi-nude imagery, sexually suggestive content (including but not limited to depictions of undressing, suggestive poses, twerking, or sexually provocative material), or any other sexually oriented content of any kind. This prohibition applies to all AI-generated content created through our platform, regardless of whether such content is placed behind a paywall, offered as a "premium" feature, or generated through any third-party AI model integrated with our Service.
All content provided on the Service, including the design, text, graphics, logos, icons, images, and the selection and arrangement thereof, is the exclusive property of Chibi Art or its licensors and is protected by U.S. and international copyright laws.
You may be able to upload, store, or share content through the Service. You retain all rights in, and are solely responsible for, the user-generated content you post to Chibi Art.
By posting content on the Service, you grant Chibi Art a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, translate, format, publish, transmit, display, and distribute such content in any and all media or distribution methods (now known or later developed).
Chibi Art employs automated content moderation filters and screening mechanisms to prevent the generation of prohibited content. All text prompts, inputs, and AI-generated outputs are screened to ensure compliance with these Terms and our Acceptable Use Policy. Users attempting to generate NSFW, sexually explicit, or otherwise prohibited content will have their requests blocked. Repeated violations may result in immediate account suspension or termination without prior notice. We reserve the right to review, monitor, and remove any content that violates these terms.
Chibi Art provides the Service on an "as is" and "as available" basis. You therefore use the Service at your own risk. Chibi Art expressly disclaims any and all warranties of any kind, whether express or implied.
To the fullest extent permitted by law, in no event will Chibi Art, its officers, shareholders, employees, agents, directors, subsidiaries, affiliates, successors, assigns, suppliers, or licensors be liable for (1) any indirect, special, incidental, punitive, exemplary, or consequential damages; (2) any loss of use, data, business, or profits (whether direct or indirect), in all cases arising out of the use or inability to use the Service, regardless of legal theory, without regard to whether Chibi Art has been warned of the possibility of those damages, and even if a remedy fails of its essential purpose.
These Terms are governed by the laws of the jurisdiction in which Chibi Art is located, without regard to its conflict of laws rules. The courts in some countries will not apply these jurisdiction's laws to some types of disputes. If you reside in one of those countries, then where these jurisdiction's laws are required to apply, the laws of your resident country will apply to such disputes related to these Terms.
By using the Service, you agree to comply with the following Acceptable Use Policy. Violation of this policy may result in immediate suspension or termination of your account, forfeiture of any pending payouts or credits, and reporting to relevant authorities where required by law.
You may not use the Service to create, generate, upload, distribute, or promote:
You may not use our Service, branding, or marketing materials to promote, showcase, or imply the capability to generate prohibited content. This includes but is not limited to the use of terms such as "uncensored," "no filter," "NSFW," "18+," "unfiltered generation," "no restrictions," or similar language on your website, landing pages, social media, galleries, or any other promotional materials.
All AI-powered content generation features on our platform are subject to mandatory content filtering. You agree not to attempt to bypass, disable, or circumvent these filters. You further agree not to use any open-source or third-party AI models that lack adequate NSFW content filtering without implementing additional robust screening mechanisms approved by Chibi Art.
